Lead-Free Products: The May 1 Deadline

1 May 2026 is when everything changes with lead in plumbing products. After that date, copper alloy products that come into contact with your drinking water must contain no more than 0.25 per cent lead. This includes taps, valves, fittings, meters and backflow prevention devices. If drinking water touches them anywhere along the line, they need to comply.

Why the big deal? Lead contamination in drinking water poses genuine risks, particularly for children and expectant mothers. Tons of current products already satisfy the existing drinking water guidelines, but this new requirement sets a much higher bar. Products that technically passed before won’t make the cut now.

Here’s where people get caught out. The date that matters isn’t when you got your building permit or when you signed the contract with your builder. It’s when the actual plumbing installation starts. Your plans could’ve been drawn up last year, permit approved in March, but if your plumber attends and starts work on May 2nd, everything going in has to be lead-free certified. Period.

What Actually Needs to be Lead-Free

Good news is, not everything in your plumbing system falls under these rules. Toilets get a pass. So do irrigation systems, dishwashers, washing machines and showerheads. These don’t touch drinking water directly or they’re used for non-drinking purposes.

Everything else that’s part of your drinking water supply needs that lead-free certification and the new WaterMark logo. Once 1 May hits, products need to carry both the standard WaterMark and the Lead-Free symbol. Plumbers can’t just use whatever stock they’ve have lying around from prior work.

Energy Rules Got Bumped Up

The NCC 2022 tightened energy efficiency requirements. Brighton’s new homes and apartments now need 7-star ratings under the National Home Energy Rating Scheme compared to the old 6-star level. New builds and major renovations both fall under this.

What do 7 stars translate to in reality? You’re looking at better insulation quality, windows that perform properly, heating and cooling running more efficiently, and generally improved thermal performance. The building envelope basically has to trap heat more effectively in cold weather and keep it out during hot spells.

Water heating rules changed too, which actually give you more options. Since November 2023, if you have natural gas connected to your street, you can pick any solar or heat pump water heater that meets efficiency standards. Before this, there were more restrictions on what you could install in areas with gas available.

One Regulator Instead of Several

From July 2025, the Victorian Building Authority got absorbed into the new Building and Plumbing Commission. Instead of dealing with multiple authorities for different bits of your project, the BPC now handles everything: registration, compliance, disputes, domestic building insurance. It’s all under one roof.

Accessibility Features Now Required

NCC 2022 brought in new rules for accessible housing in new Class 1 and Class 2 buildings. These help people with mobility issues get around their homes easier. The rules kicked in from May 2024 and apply to new construction.

While this mainly targets new builds, if you’re doing major renovations, think about adding accessibility features anyway. It adds value to your Brighton property and can make your home work better if needs change down the track, whether that’s getting older or having family members who need mobility support.

What Happens If You Don’t Comply

Skipping compliance carries real consequences. The BPC can force you to rip out and replace non-compliant products, delay finishing your project including stopping occupancy permits, hit you with substantial fines, and go after practitioners who knowingly install products that don’t meet standards.

Your insurance takes a hit too. Most policies won’t cover damage from non-compliant work or products. A water leak causes major damage and investigations show your plumbing didn’t meet current standards? You’re paying for repairs out of pocket.

What’s Coming Next

NCC updates happen every three years. More changes are coming. Water efficiency will matter even more, stormwater rules will tighten (big deal for coastal areas like Brighton), and energy standards won’t stop climbing.
